PROCESSING OF PERSONAL DATA

The protection of the personal data of natural persons is regulated in Portugal by Lei n. º 58/2019, of 8 August (hereinafter, the “LPDP” – Portuguese Data Protection Law) and by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter, the “GDPR”), which ensure the protection of natural persons with regard to the processing of personal data and the free movement of such data.

“Personal data” means any information, of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person; accordingly, this protection does not extend to the data of legal persons.

An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity (for example, his or her name associated with his or her telephone number or e-mail address).

This Privacy Policy (hereinafter, the “Policy”) relates to the processing of personal data carried out by Moving People Portugal, Sociedade Unipessoal Lda. (hereinafter, “MOVING PEOPLE”), through the website https://movingpeople.com/ (hereinafter, the “Website”).

The Website enables MOVING PEOPLE to advertise professional opportunities, manage applications and provide information about its international recruitment services for healthcare professionals.

By reading this Privacy Policy, the user is informed about the processing of personal data carried out by MOVING PEOPLE.

CATEGORIES OF PERSONAL DATA

In accordance with the purposes set out in Section IV, the following categories of personal data may be processed: 

  • Identification data (name, age);
  • Demographic data (nationality);
  • Contact data (telephone number, e-mail);
  • Professional and academic data (profession);
  • Other data: data contained in the Curriculum Vitae and any other data provided directly by the user through communications via the channels made available for that purpose;
  • Browsing data: IP address and network activity.

PURPOSES OF THE PROCESSING OF PERSONAL DATA

The personal data we collect and process shall be used solely for the following purposes:

  • Responding to contact requests and providing information requested by users;
  • Carrying out pre-recruitment activities, including the preliminary assessment of the user’s profile, with a view to identifying potential employment opportunities and evaluating the suitability of the user’s profile for recruitment processes conducted by MOVING PEOPLE.
  • Carrying out recruitment activities, including the receipt, review, assessment, management and follow-up of the application, as well as presenting the candidate’s profile to potential employers.
  • Sending commercial electronic communications.
  • Ensuring the operation, security and improvement of the Website;
  • Compliance with legal obligations arising from applicable data protection legislation, as well as the exercise of data subject rights and use in legal proceedings.


MOVING PEOPLE
guarantees the confidentiality of all data provided, collecting and processing data securely to prevent its loss or manipulation, using the most appropriate techniques for that purpose, in accordance with Section 8 of this Policy.

LAWFUL BASIS FOR THE PROCESSING OF PERSONAL DATA

MOVING PEOPLE processes the personal data of users on the basis of the following lawful grounds:

  • Performance of a contract entered into between the user and MOVING PEOPLE, through acceptance of the Website’s Terms and Conditions and for the purposes of managing pre-recruitment and recruitment activities;
  • Legitimate interest of MOVING PEOPLE in responding to contact requests and providing the information requested by users, as well as in ensuring the operation, security and improvement of the Website;
  • Consent of the data subject to the processing of his or her personal data for the purposes of sending commercial electronic communications;
  • Compliance with legal and contractual obligations to which MOVING PEOPLE is subject.

The user warrants that the information provided is true, accurate, complete and up to date, and shall be liable for any damage or loss, whether direct or indirect, that may be caused as a result of providing information that does not meet these criteria.

Where the data provided belongs to a third party, the user warrants that he or she has informed that third party of the matters set out in this document and has obtained their authorisation to provide their data to MOVING PEOPLE for the purposes indicated.

DATA RETENTION PERIODS

MOVING PEOPLE shall only retain and process users’ personal data for the period necessary for the fulfilment of the purposes referred to above, applying information retention criteria appropriate to each processing operation and in line with applicable legal and regulatory obligations.

MOVING PEOPLE retains personal data in its systems so that it is possible to identify data subjects in accordance with the following criteria:

  • for a period of time no longer than is necessary for the pursuit of the purposes for which they were collected, in accordance with Section 4, unless legal or contractual obligations provide otherwise;
  • to fulfil specific legal or contractual obligations;
  • until the exercise of the right to erasure or the right to object, which must be exercised in accordance with Section 9.

DISCLOSURE OF DATA

As part of the recruitment services provided by MOVING PEOPLE, the User’s personal data will be disclosed to employers and/or partner entities with whom MOVING PEOPLE collaborates whenever the User’s profile is considered suitable for their recruitment needs, to the extent strictly necessary for the assessment of the application and the conduct of pre-recruitment and recruitment activities.

Except in the cases mentioned above, data shall not be disclosed or transmitted to third parties or entities external to MOVING PEOPLE.

INFORMATION SECURITY

MOVING PEOPLE has implemented appropriate technical and organisational security measures to ensure the security of the personal data provided to it by the respective data subjects, with a view to preventing its alteration, loss, unauthorised processing and/or access, taking into account the current state of technology, the nature of the data stored and the risks to which it is exposed.Whenever accessing personal data, MOVING PEOPLE undertakes to:
  • Retain data by means of legally required technical and organisational security measures that guarantee its security, thereby preventing its alteration, loss, unauthorised processing or access, in accordance with the state of technology at any given time, the nature of the data and the possible risks to which it may be exposed;
  • Use data exclusively for the purposes previously defined;
  • Implement physical security measures for the protection of premises;

Ensure that data is processed solely by employees whose involvement is necessary to fulfil the data subject’s request, and that such employees are bound by a duty of secrecy and confidentiality. Where there is a possibility that information may be disclosed to third parties for the aforementioned purposes, such third parties must be bound to maintain due confidentiality in accordance with this document.

EXERCISE OF RIGHTS

In accordance with the provisions of the GDPR, the data subject may exercise his or her rights of access, rectification, erasure, restriction of processing, data portability, objection, withdrawal of consent and the right not to be subject to automated decision-making, by making a written request through any of the following means, specifying the right or rights he or she wishes to exercise:

The data subject has the right to lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD) regarding matters relating to the exercise of his or her rights and the protection of his or her personal data, through the following web page: www.cnpd.pt.

AMENDMENTS TO THE PRIVACY POLICY

MOVING PEOPLE reserves the right to revise this Policy at any time it considers appropriate; accordingly, it is recommended that the user checks this Privacy Policy regularly.
